Q: What happens if an establishment’s Manager of Record (MOR) passes or becomes incapacitated?

A: If the manager of record (MOR) of the funeral service establishment is unable, for any reason, to exercise adequate supervision, direction, management, and control of the funeral establishment, the owner shall designate any funeral service licensee to serve as a temporary MOR and notify the Board in writing within 14 days. These reasons include, but are not limited to, death, illness, impairment, or incapacity.

If such inability of the MOR exceeds 90 days or is expected to exceed 90 days, a new MOR shall be designated and registered with the Board. At the conclusion of the 90-day period for the designation of a new MOR, a funeral service establishment which has failed to designate a new MOR shall not operate as a funeral service establishment.

It is recommended to consult an attorney regarding any legal questions related to state and federal laws and regulations, including the interpretation and application of the laws and regulations of the Virginia Board of Funeral Directors and Embalmers.

A: As there may be legal implications related to the owner’s estate and successors, licensees are encouraged to consult with an attorney regarding any legal questions related to state and federal laws and regulations, including the laws and regulations of the Virginia Board of Funeral Directors and Embalmers.

Where ownership of the establishment changes by virtue of the passing of the previous owner, the new owner(s) should submit a Funeral Service Establishment/Branch application indicating a change of ownership with re-inspection.
