What is a hardship waiver of full-time manager?

A hardship waiver application allows for a licensed Funeral Service Licensee or Funeral Director to serve as the Manager of Record and operate two funeral establishments concurrently and to divide their time between the two funeral establishments.

What are the requirements to qualify for a hardship waiver from the requirement for a full-time manager?

In order to qualify for a hardship waiver, the establishments must meet the requirements listed below:
•    The two establishments have been in operation for at least three years;
•    The combined average number of funeral calls at the two establishments over the previous three years is no more than 135 per year; and
•    The distance between the two establishments is 50 miles or less.

Am I required to get approval from the Board for a hardship waiver?

Yes, the Board must grant a hardship waiver before a licensee can serve as the Manager of Record at more than one establishment. 

What application should I submit to the Board?

A Waiver of Full-Time Manager application should be submitted for consideration. An initial application fee of $150.00 is required for processing.

What documentation do I need to provide with my hardship waiver application?

For an initial application, you must submit copies of either (1) the monthly vital statistics reports or (2) a report(s) generated from the EDRS system that show the funerals processed through each establishment for the last three (3) years. 

For a renewal application for waiver of full-time manager, you must submit copies of the monthly vital statistics reports or a report generated from the EDRS system for each establishment for the last one (1) year.

Do I need to renew my hardship waiver once granted by the Board?

Yes, you are required to renew your hardship waiver before March 31st of each year using the Waiver of Full-Time Manager application. A renewal application fee of $100.00 is required for processing.
