Information for Registered Agents
The law currently provides for an affirmative defense for a registered agent to possess cannabidiol (CBD) oil or THC-A oil as defined in §54.1-3408.3 of the Code of Virginia. A patient, or, if such patient is a minor or an incapacitated adult as defined in § 18.2-369,such patient's parent or legal guardian, may designate an individual to act as his registered agent for the purposes of receiving cannabidiol oil or THC-A oil pursuant to a valid written certification. The patient, or parent/legal guardian, must have been issued a written certification and be registered with the Board to possess cannabidiol (CBD) oil or THC-A oil as defined in §54.1-3408.3 of the Code of Virginia.
The registered agent shall register with the Board prior to receiving cannabidiol oil or THC-A oil. A registered agent may act in such capacity for no more than 2 registered patients.
